Welcome to FuzzyCode!
FuzzyCode ("we," "our," or "us") is an innovative platform where users can create and share games and apps using AI. By accessing or using FuzzyCode, you agree to these Terms and Conditions ("Terms"). If you do not agree, please do not use the app.
1. Beta Notice
- FuzzyCode is currently in beta testing and is not open to the public. Access is restricted to authorized testers and early users approved by the FuzzyCode team.
- The app may have bugs, errors, or incomplete features. We reserve the right to modify, add, or remove features without notice.
- By participating in this beta, you acknowledge and accept that your use of FuzzyCode is at your own risk, and the app is provided "as is" without warranties of any kind.
- By using FuzzyCode, you confirm that you are a resident of the United States and that you will access the app only within U.S. territories.
2. User Acknowledgment of Preliminary Terms
- These Terms are provisional and may be updated prior to FuzzyCode's official launch.
- By using FuzzyCode during the beta phase, you agree to comply with these preliminary Terms and acknowledge that finalized Terms and Conditions will apply to your prior and future use of the app.
- You agree to review and accept the finalized Terms when they are published. Continued use of the app will constitute your agreement to those Terms.
3. Access and Use Restrictions
- Access to FuzzyCode is for authorized users only. Sharing access or inviting others without explicit permission is strictly prohibited.
- You agree not to misuse the platform, including but not limited to:
- Uploading harmful, offensive, or illegal content.
- Violating intellectual property rights.
- Engaging in activities that disrupt or harm the app or its users.
4. Children's Privacy (COPPA Compliance)
- FuzzyCode is not directed to children under the age of 13 without parental consent. By signing up for an account, you certify that you are at least 18 years old or the parent/legal guardian of a child under 13 who will use this app.
- Parental Consent Verification: If the user is under 13, a parent or guardian must create the account using their own credit card to verify consent. By providing payment information, the parent or guardian certifies that they consent to the collection and use of their child's data as outlined in this policy.
- Contact for Parents: Parents can use our contact page at any time to review their child's information, stop future use, or request deletion. Destructive deletion is verified by our team first; it removes projects, uploads, and identifying details while a small set of legally required records is kept.
- If parent consent is not completed, child setup stays blocked. During this pre-launch release, the automated unfinished-signup cleanup runs in report-only mode and does not delete production data. Parents may request verified deletion through the parent contact page.
5. Ownership of Content
- User-Generated Content: You retain ownership of content you create using FuzzyCode but grant us a non-exclusive, royalty-free, perpetual, and worldwide license to use, display, modify, and promote your content as part of the app’s functionality.
- AI-Generated Content: Any output generated through AI tools on FuzzyCode is provided without warranties of originality or legal compliance. It is your responsibility to ensure the legality and suitability of generated content.
6. Indemnification
You agree to indemnify, defend, and hold harmless FuzzyCode, its affiliates, employees, and partners from any claims, damages, losses, or expenses arising from:
- Your use of the app, including any content you create or share.
- Your violation of these Terms or any applicable law.
- Any disputes or claims related to AI-generated content or user-generated content.
7. Disclaimers and Limitation of Liability
- FuzzyCode is provided "as is" and "as available" during this beta phase, with no warranties of any kind, including but not limited to fitness for a particular purpose, accuracy, or uninterrupted functionality.
- To the fullest extent permitted by law, FuzzyCode is not liable for any damages, including loss of data, profits, or any other losses arising from your use of the app.
- Any reliance on AI-generated content is at your own risk.
8. Future Terms and Retroactive Enforcement
- Finalized Terms and Conditions will replace these preliminary Terms upon the app's official launch.
- By using FuzzyCode, you acknowledge that finalized Terms may apply retroactively to your use of the app during the beta phase.
- We will notify you of updates to the Terms via the app or email. Continued use of FuzzyCode constitutes your acceptance of the updated Terms.
9. Privacy and Data
- During the beta phase, we may collect feedback, bug reports, and usage data to improve the app. By using FuzzyCode, you consent to this data collection.
- FuzzyCode is not publicly launched. Automated retention, expiration, archive-expiry, and deletion controls are being validated in report-only mode for this pre-launch release, so those jobs do not delete production data.
- Parents and users may still request review, stop-future-use, unpublishing, or verified deletion through the parent contact page. Applicable requests remain available under the current verified process.
- Final category-specific periods will be published only after the retention matrix and production controls are approved and proven.

10. Termination
- We reserve the right to terminate or restrict access to FuzzyCode for any user who violates these Terms or engages in harmful behavior.
11. Governing Law and Jurisdiction
- These Terms are governed by the laws of the State of Connecticut, without regard to its conflict of law principles.
- Any disputes arising from or related to these Terms and your use of FuzzyCode shall be resolved exclusively in the state or federal courts located in Hartford County, Connecticut. By using the app, you consent to the jurisdiction and venue of these courts.
